Innocent Man Had To be Dragged Out Of Police Car After Police Realized Their Mistake.
FARGO, N.D. – A Fargo Police officer has been cleared in a mistaken identity case, stemming from a January traffic stop. After an investigation, Fargo Police found the officer’s actions were legal, justified and within policy. There was no foundation of racism.
Officer Duncan pulled Kayee and his girlfriend, Wyneta Fully, over outside of an area hotel due to the front license plate not being displayed properly. Body camera video released to the public shows Kayee did not have his driver’s license or insurance card.
Authorities say when Officer Duncan ran the name “Abenico Kayee,” he got an alias for Johnny Cooper. The officer compared booking photos and believed it was the same person.
Officer Duncan instructed Kayee to get out of the car and told him about the warrants, according to body camera video. Kayee was hand cuffed and put in the back of a squad car as dispatch worked to confirm the warrants.
When Officer Duncan’s supervisor arrived, he immediately determined they had the wrong man. Video shows Kayee was free to go at that point. Officers offered to give him a ride initially.
However, he declined and refused to get out of the squad car without seeing any paper work. Video shows Kayee was eventually pulled from the car and the interaction ended.
The entire thing lasted about an hour.
